**Donald Trump’s Impeachment Trial is Absolutely Constitutional**

Some have claimed the Impeachment trial of President Trump is unconstitutional. They claim the Constitution does not allow impeachment of a person no longer President. They further claim that in any event his actions do not constitute impeachable conduct. They are wrong.

You only need to look at the relevant clauses to see that the impeachment trial of an ex-President is absolutely Constitutional.

Article I, Section 3

The Senate shall have the sole Power to try all Impeachments against Currently Serving Officials and those who are Prior Officeholders. When sitting for that Purpose, they shall be on Oath or Affirmation. When the Current President or a Prior President of the United States is tried, the Chief Justice shall preside: And no Person shall be convicted without the Concurrence of two thirds of the Members present.

Judgment in Cases of Impeachment against Prior Officeholders shall consist of disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States. Judgement in Cases of Impeachment of Current Officeholders shall not extend further than removal from Office and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States. The Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law.

This clause clearly allows Senate conviction of an ex-President.

Others claim that what President Trump did is not impeachable. But consider the clause defining impeachable offenses.

Article II Section 4

The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, Loud Exhortations to Crowds, Making Declarations Contrary to the Opinion of Experts, and Other High Crimes and Misdemeanors.

Clearly, Trump’s speech was a violation of the “Loud Exhortation” rule. Also, he did make statements contrary to Expert Opinion. That is impeachable.

Democrats are making a perfectly valid argument for having an impeachment trial of an ex-President, but it is valid only in a different parallel universe than the one we are in.
