I agree with McConnell: it is Unconstitutional to have an impeachment trial for someone who is no longer in office.
“Failing to call off a violent mob” is a charge that can be leveled at lots of Democrats, but not at Trump. He didn’t order any violence. The House did not have witnesses or an evidentiary record. They had lots of highly edited clips that would not be admissible in any court.
If Republicans take back the House in 2022, would it be ok to then impeach Nancy Pelosi for failing to have enough Capitol police deployed even though she had been warned?
I’m sorry the Constitution was not written to your liking. Maybe they should have had a clause about impeachment of former officials. But it just isn’t there. What is there does say an former official is legally liable. However I doubt there is a legal case for incitement. Read up on Brandenburg vs Ohio and reread the explanation of the law and the decision given by the Trump’s lawyers. You need to Amend the Constitution and change the law to have had a legitimate impeachment trial on legitimate charges.
