I think I mentioned the Roberts ruling was predicted on the ACA Individual Mandate penalty being viewed as a tax. When Congress repealed that penalty provision, it removed whatever sheer screen there was giving the ACA some Constitutional legitimacy. Twenty or more states have since sued to overturn the ACA . Federal District Court Judges have agreed it no longer passes muster. We don’t know how Justice Roberts will decide on the ACA sans Tax, but he would have to ignore his own legal logic to now uphold the ACA.
